1. Acceptance of Terms
These Terms of Service form an agreement between you and the operators of ContractBonding.ca("we", "our", or "us") covering your use of this website (the "Website"). By accessing or using the Website you agree to these terms. If you do not agree, please do not use the Website.
2. What We Do
ContractBonding.ca provides general information about surety bonds and a way for contractors to request bonding quotes. We are not an insurance company or surety, and we do not ourselves issue bonds. Surety bonds are placed by licensed insurance brokerages and issued by licensed surety companies. Where we pass your inquiry to such a firm, that firm is responsible for its own advice, underwriting, and bond placement, and its own terms apply. We may receive a referral fee or other compensation from firms we refer inquiries to; where required by law, we will tell you before you proceed.
3. Information Only — Not Professional Advice
Content on the Website, including guides and bond explanations, is general information for Canadian contractors. It is not legal, financial, or insurance advice for your particular situation, and it may not reflect the latest changes in law or market practice. Please confirm requirements with the project owner, your broker, and your own advisors before relying on it.
4. Calculator Estimates & Preliminary Quotes
Premium figures produced by the Website's calculators are non-binding illustrations only. Actual premiums, collateral requirements, single-job limits, and facility capacity are set solely by a surety company after underwriting review of your financial statements, work-in-progress schedule, credit, and the contract terms.
5. No Guarantee of Approval or Timing
Submitting a form does not guarantee that a bond will be offered, approved, or issued, or that any response will arrive before a tender or bid closing deadline. You are responsible for allowing enough time to obtain any bond you need and for meeting every deadline set by a project owner. Do not rely on the Website as your only means of obtaining a bond for a time-sensitive tender.
6. Your Responsibilities
When you submit information through the Website, you confirm that it is accurate and current and that you are authorized to submit it on behalf of your business. You agree not to misuse the Website, interfere with its operation, attempt unauthorized access, or submit information you do not have the right to share.
7. Disclaimer of Warranties
The Website and its content are provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties or representations, express or implied, including about accuracy, completeness, fitness for a particular purpose, or uninterrupted or error-free operation.
8. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, punitive, or consequential damages, or for lost profits, lost contracts, or missed tender opportunities, arising from your use of, or inability to use, the Website, including Website downtime, delays in responding to inquiries, or reliance on calculator estimates or other content. Our total liability for any claim relating to the Website is limited to the greater of one hundred Canadian dollars (CAD $100) and the amount you paid us for use of the Website in the twelve months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.
9. Indemnity
You agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable legal fees) arising from your breach of these terms, your misuse of the Website, or inaccurate information you submit.
10. Third-Party Links & Services
The Website may link to third-party websites, such as government regulators, tendering portals, and industry bodies. We do not control and are not responsible for their content, availability, or practices. Your dealings with any third party, including a brokerage or surety company, are solely between you and that party.
11. Intellectual Property
The text, graphics, logos, and design of the Website are protected by Canadian and international copyright and trademark laws. You may view and print pages for your own business use. Any other reproduction, distribution, or automated scraping requires our written permission.

13. Changes to These Terms

14. Governing Law & Jurisdiction
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-law rules. You agree that the courts of British Columbia have exclusive jurisdiction over any dispute arising from these terms or the Website.
15. Severability & Entire Agreement
If any provision of these terms is found unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will stay in effect. These terms, together with the Privacy Policy, are the entire agreement between you and us about the Website. Our failure to enforce a provision is not a waiver of it.
